TERMS AND CONDITIONS
Definitions
In this user agreement, the words below have the following meanings assigned to them:
“data protection laws” means the Protection of Personal Information Act, 4 of 2013, the General Data Protection Regulation, 2016/679, published by the European Parliament, and any applicable data protection laws to which ArcelorMittal South Africa Limited is subject;
"we", "us", "our" and "ArcelorMittal" means ArcelorMittal South Africa Limited and all direct and indirect subsidiaries;
“App” means SteelTalk mobile application, known as SteelTalk;
“user agreement” means the terms of use set out herein; and
"you" and "your" means the user of the App
Introduction
This App has been developed specifically for use by employees of ArcelorMittal South Africa, and any person specifically authorised by ArcelorMittal South Africa, as mobile-centric cloud-based employee engagement and communication platform and to provide essential employment services, such as internal company announcements, notices as well as leave and payslip administration (“Employment Services”).
We operate the App to provide the Employment Services to employees and authorised registered users, within ArcelorMittal South Africa Limited.
In this user agreement we set out, amongst others, the terms and conditions in terms of which we may obtain, use, and/or disclose your personal information, in accordance with the data protection laws.
Terms of use of the App
This user agreement, and the terms of use set out herein, shall govern your use of the App and all applications, software and services available on or via the App.
You are required to carefully read the terms and conditions set out in this user agreement before using the App.
If you use the App, you will be deemed to have accepted the terms and conditions set forth herein. If you do not agree to all the terms and conditions, you must not use this App.
To the extent that any of our webpages or applications accessible though the App are governed by additional or different practices or policies, these practices or policies will be accessible on that page.
Modifications
We reserve the right to change or update these terms and conditions at our sole discretion and at any time without prior announcement by posting any changes or updates on the App. The new terms will be effective immediately once they are posted on the App, and by continuing to use this App you will be deemed to have accepted the new or updated terms and conditions.
You acknowledge that this App is the property of, and is published by, ArcelorMittal. You may only use the App for lawful purposes and you warrant that you will not use the App and the contents therein in violation of any law or regulation.
You represent that you have full legal capacity to agree to be bound by the terms and conditions of this user agreement, and your access to the App is granted in reliance on that representation. The benefits of these terms and conditions extend to each of the ArcelorMittal Group companies without notice of acceptance, which you are deemed to have waived.
Intellectual Property
The App, the intellectual property, and all software are protected by copyright. All rights in the ArcelorMittal trademarks, computer code, logos and other graphics, tools, calculators and devices remain the sole property of ArcelorMittal or its affiliates. We do not grant you any licence or right to use any of our trademarks or other intellectual property on this App by virtue of your use of or access to the App. Unauthorized use of any copyrighted materials; trademarks or any other intellectual property without the express written consent of ArcelorMittal is strictly prohibited.
The above mentioned content may not be sold, distributed, transmitted, copied, modified or decompiled, in any way, without the prior written consent of ArcelorMittal. Any unauthorised use of the content is expressly prohibited and may constitute a violation of copyright law, trademark law, patent law or other industrial property rights.
You may only download, display and print one copy of the Web Site on your personal mobile phone for private and personal purposes and/or purposes allowed by the applicable law.
Restrictions on the use of the App
In addition to other restrictions otherwise set forth in this user agreement, you agree that:
- you will not disguise the origin of information transmitted through the App;
- you will not place false or misleading information on the App;
- you will not use or access any service, information, application or software available via the App in a manner not expressly permitted by ArcelorMittal
Limitation of Liability
You agree to access and use the App at your own risk. ArcelorMittal shall not be liable for any damages or injury resulting from your access to, or inability to access this App, or from your reliance on any information provided in the App.
By accessing this App, you agree that ArcelorMittal or any of its affiliates will not be liable for any direct or indirect loss arising from the use of the information and material contained in this App.
Employee Privacy and Consent
By using this App, you agree and consent to the collection and use, by ArcelorMittal, of information made accessible or available on or through this App (including your personally identifying information) consistent with the data protection laws and any privacy policy applicable to ArcelorMittal employees from time to time.
This App may contain links to web pages or applications not operated, controlled or supervised by ArcelorMittal. These links are solely provided for your convenience. If you follow these links, you’ll leave the App, and will be subject to the terms of use and privacy policy applicable to those web pages or applications. By providing such links, ArcelorMittal makes no judgment or warranty with respect to the Apps accessible through the links and ArcelorMittal takes no responsibility or liability for the accuracy of the information or material published on these Apps.
You are not permitted to link any other website, web page or application to this App without obtaining our prior written consent and where we do provide consent, subject to any conditions that we may impose.
You acknowledge that ArcelorMittal may for purposes of providing the Employment Services and other business related reasons, share information, including your personal information, external business partners, service providers or suppliers (some of whom may be located outside of the Republic of South Africa) who may have a justifiable/legitimate interest or contractual obligation or right in obtaining the information.
In consideration of the above, the Employer will ensure that it executes the appropriate policies, procedures and/or contractual documents applicable to members of the ArcelorMittal Group or with the relevant third parties in accordance the applicable data protection laws and policies to ensure that your personal information is protected.
The Personal Information processed on or through this App will be retained for as long as it is necessary to give effect to the purpose for which it was collected or otherwise for the periods specified in the Records Management and Retention Policy and shall be disposed in accordance therewith.
You have the right to withdraw your consent to the processing of your Personal Information on this App, at any time, by using the deregistration functionality on the App.
Severance
If any term of this user agreement is held by any competent authority to be invalid or unlawful or unenforceable, it shall not affect the enforceability of any of the remaining terms of this user agreement.
Waiver
If we do not exercise any right under the terms of this user agreement then that shall not constitute a waiver of that right.
Applicable law and Jurisdiction
Your use of this App, and any downloads from it, and the operation of this user agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa and any dispute arising out of or in connection with your use of this App shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
